Factors to Evaluate in a New Business Lease
- What is the desired duration of the lease?
- Will the lease be a full repairing and insuring lease (FRI lease)?
- Do you intend to make modifications to the property?
- Is there a break clause? This is typically crucial if the lease extends for 10 years or more
- Rent review – if a rent review is to be incorporated, how will it function? There are numerous methods and will any review only increase?
- Transfer or sub-leasing – are these allowed and if so, under what conditions?
- Service charges – particularly significant for offices, these can be quite costly, so transparency is key and many lessees aim to negotiate some sort of limit or ceiling on service charge costs
